lease of government land

(Querist) 05 July 2011 This query is : Resolved
Government had allotted land on lease basis for 30 years to our client. After completion of 30 years government is not ready to renew the same.

Government is wanting to do commercial activity as we are also doing the same.

What about constuction, development and goodwill?

When lease period is over, you have to vacate it, otherwise Govt., would take legal action against you.

Agreed. As requried for public interest then no problem, but taking from one and giving to another is how right?

Please advice.

It may be useful to read through the conditions of lease.

How would you prove that the lease to you is more beneficial.
Dushyant Pandya (Querist) 28 August 2011
Marshi Land was alloted, which was developed as per lease conditions.
No breach was found during the lease period.
Now, not renewing the said lease, as the lease land is not required for their own use or for national interest.

Please provide way out or authorities in that support.

Since the lease remains valid for a specific period, the renewal depends upon the sole criteria of the competent authority, as the lessee cannot compel the authorities for renewal irrespective of whether tha land is required or not for the use of the Government or developmental activities.

However, lessee can make appeal to the higher authorities only to present merits of his case for reconsideration of his application for renewal.

I don't think any litigation can help you in that case.
