Sir,
Ours is an apartment consisting 20 flats in Andhra Pradesh (Vijayawada). One of our flat owner intends to install solar power panel on common terrace of apartment. He is claiming that he has right on terrace and install the solar panel. Is it require consent/permission of all other flat (19) owners for installing solar power panel by individual. If any group consisting majority or 5 flat owners objects what action to be required to deny installation of solar panel on common terrace of apartment. The terrace is a common area. The common areas come under the control of society. No individual member can claim a right over it. However the society can permit the member requesting permission for this.

With growing environmental concerns, the use of solar energy is increasing rapidly This renewable energy source is widely being adopted in commercial, residential and industrial sectors. Solar energy can be harnessed through rooftop solar installations. In case the terrace of your building is a shared asset among all the flat owners, you may have to seek permission from the housing society before installing the solar panel system. You will require approval from your electricity provider and the local municipal authority to install a solar on-grid system. If you install solar panels at a 10-foot height, permission from the municipality is required. Therefore you may first obtain permission from the association for installation of the proposed solar panel

Yes, if the committee permits the owners to install the solar system on the common terrace, any owner may install it.
