Can I file Insolvency against Company as an employee? Company has kept salary pending since last 4 month

You as a last chance file a case to recover your salary but not insolvency. A process can be initiated by applying with the adjudicating authority, which is the National Company Law Tribunal.

When the salary is due from the employer, the employee himself or any other person authorized by him in writing on his behalf can claim recover money.
Criminal Suit: It is the liability of the employer to pay the salary to the employee on time. However, if he denies, refuses, or fails to do so, then the employee can file a criminal suit for cheating and breach of trust under Section 420 of the Indian Penal Code.
