injunction

(Querist) 22 June 2010 This query is : Resolved 
an order of temporary injunction has been passed in a civil suit. but subsequently certain alterations has been made in the subject-matter(land) in violation of the order. the person responsible for such alteration is not a party to the suit but is believed to be a acquaintance of the defendant (though no solid proof). can this person be made a party in the violation proceedings under Order 39 Rule 2A of CPC? Was the injunction order binding upon him?

Any similar case laws????

Yes. Any person coming in the way of maintaining the decorum of court order/direction in any case shall have to face similar consequences as if he was also a party to the suit.
