I m tenant prior to 5 yrs back the rent agreement is expressed in writing in the month of march 2004 . In the month of april 2005 the owner of the premises broken the lock and tried to disposses me , i have filed suit for injunction the court given me temp injuction, now the matter is fixed for final hearing, so can any one give citation regarding perpetual injunction against said landlord.

for injunctions matter u need not to cite authorities to a greater extent.

if you are able to show the landlord tenant relationhip in that case the court will grant the injunction.

make sure you are not in unauthorise possession or a tresspasser.

the basic concept is the person who seeks injunction must go to the court with CLEAN HANDS....i think you can understand.

Refer to Sec. 38 etc of Specific Relief Act.

In other respects Mr Kiran is right.

A tenant cannot be dispossessed by a landlord without due process of law. Your rights will be protected. You do not need citations for it. Certainly you will get the injunction order in your favour.

But subsequent to the injunction order, if the landlord takes seperate proceedings for eviction then you may have to quit the premises.
