Querist : Anonymous (Querist) 28 December 2011 This query is : Resolved 
whether the letter of administration can be filed( in delhi) without will, if so,
under which provision in respect of the immovable property of the intestate.

With0ut copy of Will an application for neither Probate nor Letters of Administration could be filed.

No. it cannot be filed without the will. Will has to probate

NO PROBATE OR LETTER OF ADMINISTRATION OR ANY PROBATE CAN BE FILLED "in respect of the immovable property of the intestate" AS THEY CAN BE FILED ONLY in respect of the immovable property of the testate ,ie.,when deceased died testating a will in which if he appointed any executor of will then probate is issued and if he did not appoint executor then letter of administration is issued.
