Indian citizen could be punished under The Foreigner Act, 1946

Sir, I would like to know whether a Indian husband could be punished for violition of the provision of The Foreigner Act, by his wife [Foreigner] for residing in India without proper permit? Sir, it would be helpful if you explain with recent case law.

If the husband is the co-conspirator or the abettor in the offence, then he could be punished.
