in near to My has constructed his new building and he has encroched /extended his building upto about 6 cent in railway land, railway officers are not taking any action despite knowledge of this encrochment for the reasons best known to them, i have heard that there is spesific provision under Railways property (unlawful possession )Act in respect of encrochment on railway land, i am ready to move written complaint before railways authority for registration of FIR against this encrochment , i want to know any public man can file complaint for registration of FIR in such situation,kindly help,railway officers are not taking any action ,kindly also suggest me any remedy/provision so that i can file complaint/petition in court directly,Thanks .Regards

Now from some time in past the supreme court has been found liberal in construction of term which we popularly call 'locus standi',since railway land and property is public property,any inaction reluctance shown by its executives to remove encroachments,may give birth to any man from public to set the law in motion to protect the public property from individual grab.Hence you can go ahead.

Instead of fir, Make RTI Application stating the present status of that encroched land directly to Concern Railway authority.
It would work as you want.
Alternatively, you can complain the same.

sir one person was construct building in my land . now that guy should ask i will pay money.so now how will create document for that.

27feet length* 2.25 feet width this distance land was occupied.that occupied person was ask i want that land i will pay money for that occupied land.that land total area is 60 sq.feet. how will create document for that and in future that person will make any problems wat can i do plz give one solution sir
