Handing over of registered society from builder to society

I am from Navi Mumbai. Our building has 91 flats with 38 parking slots (Including stilt and open). Builder has registered the society six months back. He has sold 28 parking and has not given proof to anyone. Builder is ready to handover the society iff society agrees to accept in writing on society letterhead that parking has been allotted by society to those 28 people.
We want to take charge of society but without this clause. what is the way out?

move the consumer forum against the builder . regarding failure to submit accounts . dont agree that society has alloted the said 28 parking slots .
