(Querist) 14 January 2014 This query is : Resolved 
Dear Experts,
Through family settlement deed, received the following property: a) A house of 950 sqft with one third UDS share of common passage of 630 sqft plus b) a shop of size 12 x 15. Now I want to sell only the house and retain the shop, both are in one document.

If the seller is to be given original previous document, how I will have my shops document?

It is upto whether to give the past deed or not.
Since you have one property left it is advisable not to part with the original.Ask the buyer the get the certified copy of the same.

For the present the buyer can be given with a certified xerox copy of the document but late on after sub-division of the same, he can get the original document on his name with regard to the property he purchased out of the entire property.

In the buyer’s document, endorsement will be made to the effect that Schedule I house and Schedule II Un Divided Share of common passage is sold to buyer and the balance Schedule III Shop is retained with the seller. Therefore, certified copy of sellers Document No. 1234/2006 was given to buyer.
Then how to make deduction in the retained original document No. 1234/2006 of Schedule I & II?
Any additional stamp duty is to be paid to the registrar’s office for that receipt.

You need not part with the original document. Ask the buyer to get a certified copy of the same or you may supply such certified copy.

Dear Experts
The property (House with common passage rights) was sold and the shop was retained. In the sale deed it was mentioned and original was retained by the seller. How to deduct the house in the original document?
