Further investigation or reinvestigation ?

Querist : Anonymous (Querist) 18 December 2010 This query is : Resolved
Charge sheet has been filed by the police. Can higher officer direct to the I.O. to investigate the matter again ? If so , does it amount to a direction for re investigation or simply a further investigation ?

no, a higher officer can not direct to further investigation of a case, its only court who can give permission to the police for further investigate or re investigate the matter.

I disagree. Sec.173(8)Cr.P.C. does not vest the powers with the courts alone. Even the police officers are given the powers to do further investigation. Such power includes the power of a superior officer to direct his subordinates to do further investigation if any new matters come to light.
Advocate. Arunagiri (Expert) 19 December 2010
I agree with Mr.SS. The police I/o need not get permission from the court for further investigation.
