R/experts, Which complaint can be filed if a deponent filed affidavit on oath in a civil suit and the contents of that affidavit are false? Is this an offence? If yes which section will apply for this offence? Can police machinery take cognizance of this offence? What should be done if police machinery did not take cognizance? May complaint U/s 156(3) of Cr.P.C. be filed against deponent?

Perjury can be filed u/s 340 CrPC r/w 195 CrPC.

An individual cannot file a complaint. Only the judicial officer(the court in which it is committed) can initiate the proceedings.

It is not a matter of Police authority,Court may take cognizance u/sec.198 Cr.P.C. and may be referred to Judicial Magistrate Court.

198 Cr.P.C deals with complaint of marriage laws not civil laws. Section 340 Cr.P.C is the correct procedure.
