Extension Employment Contract

We are a trading company in India and our General Manager is a Japanese person and his employment contract is expired on 31.03.2011 but management is willing to extend the contract upto 31.03.2012. so what are the requirements and what is format of employement contact. please advice.

you can simply issue a extending the period of contract and can ask consent of employee over it.

I Agree With Mr.Tripathi Sir A contract of employment is a bilateral agreement for the exchange of service and remuneration over a period of time. The acceptance of such contract must be absolute and unqualified, be expressed in some usual and reasonable manner as provided under Section 7 of Indian Contract Act, 1872.The contract of employment should have free consent of both the parties and should not be caused by fraud, misrepresentation, coercion and undue influence. The promise to employ and be employed may be of short period but still it forms an integral part of contract.

If the contract is extended without alteration terms the procedure suggested by Mr.Tripathi can be adopted.

If the clauses are changed, you have prepare a fresh contract.
