Hello ,

I was being insulted by opposite party's lawyer everytime we had a hearing. The opposite party's lady lawyer, purposely coming close to my place where I was sitting near court and purposely directing some abusive, insulting sentences which I was tolerating since one year. But at our last hearing day, I could not tolerate her and slapped her very well and also given some nice reply and also threatened her not to do this next time onwards. I am also a lady and but since last 1 year I suffered a lot, I could not control my anger on her. I want to know what action she can take on me for doing this? No known person was around when this happened except my husband who is the opposite party and who had filed for divorce. Pls let me know if she files a complaint against my this act, what sections and what theories she can use there? What are other challenges I will have to face for my this act? Since she is a lawyer, for her filing any case against me will be free of cost and probably purposely they ( my husband and his lawyer) were trying such things so that their divorce case becomes strong with such type of cases against me. Pls tell me what else she can do in this regard.

as you mentioned that you slapped her and threatened her.... she can file a case against you under section 323, 341 IPC. for causing simple hurt and wrongful restraint.

thank you acharya but what will be the punishment under these sections? how the police will communicate it to me? Will it be a arrest or just a police case?

323. Punishment for voluntarily causing hurt
Whoever, except in the case provided for by section 334, voluntarily causes hurt, shall be punished with imprisonment of either description for a term which may extend to one year, or with fine which may extend to one thousand rupees, or with both.

341. Punishment for wrongful restraint
Whoever wrongfully restrains any person shall be punished with simple imprisonment for a term which may extend to one month, or with fine which may extend to five hundred rupees, or with both.

both offences are bailable. need not to worry about arrest

you should have controlled your self, you have made a mistake, some times we have to tolerate till we accomplish the things, why you sat near her? you would have changed your place. ...

you were knowing it was a trap but....

jo hogaya so hogaya,

jo bi hota hai hamare balayee keliye hota hai...

all the best
