agreement to pay comission

I am a real estate consultant i had registered my firm with govt of andhra pradesh. as i am a real estate consultant people approach me and for property needs and after fulfilling their requirement the are not paying the commission charges to avoid this i think i should take a agreement to pay the commission duely signed by my client before the deal starts i would kindly request to give me a format of the agreement to pay commission.

Mr. Mahesh as your feild of business consists several ifs and buts, do you think your client will sign an agreement with you before hand? if think you have such clientelle i suggest you to this type of format.

ABCD, a real estate consultant as 1st party

and

XYZ, s/o. d/o. w/o. represented by as 2nd party

Whereas the 1st party is in the field of real estate for the past -- years, having a registered office and branch offices at (if any) running the business as per the rules and regulations prescribed by the Governement and duly registered with the concerned authorities vide regd No.

That the 2nd party is interested in investing in real esate/purchase a property/take a property on lease and approached and requested the 1st party to render its services. The 1st Party agreed to the request of the 2nd Party and assured to render its services basing upon the folowing mutually agreed terms and conditions:-

1. That the 1st party has to show the building/plot/land according to the requirement/specification of the 2nd party.

2. That upon finalisation of a building/plot/land The 1st party shall provide photocopies of all the necesary and relevant documents so as to ascertain the legality of the building/plot/land.

3. It is mutually agreed by both the parties that the 1st party takes no responsibilty or doensnot indemnify the 2nd party about whether the intending seller has valid title or not. It is the risk of the 2nd party and the 2nd party has to take all necessary precautions and valid steps to acsertain the legality of the building/plot/land.

4. The 2nd Party agrees to pay service charges to the 1st party upon finalisation of a deal at the rate of 1% of the total sale consideration(as you charge) at the time of registration/entering into agreement.

This is a formal agreement and i have to add many more clauses to you as per the information provided by you so please let me know your main area of business i.e., whether you deal in lands or buildings, sale or finding a property for lease etc. so that i can prepare a common agreement for you and you can use it for all purposes.
