Your question is whether final report presented on 89th day shall enlarge the accused for bail. I think you want to ask whether the accused is entitled for the benefit of the provision of bail if final challan is not submitted till 90 days. You are not entitled for this benefit because the challan has been filed on 89th day. Otherwise you can file your bail application as and when you desire irrespective of putting the chalan by police authorities.riven
