Can you revert on the following wrt the Society matter.

After the elections conducted by the Administrator placed by the Registrar held on 27th May 2012 and new members have been elected to form a Committee , How soon the elected members shouldtake the charge ( what should be the time frame).

What is the time frame to fill in the M 20 bonds.( at that time it was applicable) is it mandatory to file after they have been elected or after taking the charge of the office

If the society is been under the Administrator, How compulsory it is to have the AGM and if it is mandatory what is the last date to have one.

The committee says that they have been given and taken charge on September 9, 2012.
Is the committee right in doing so, Is this permissible under the Maharashtra Co-op Act.
Can the committee be dissolved on the basis of not filing the M 20 bond, Forming the committee after 3 months of the election being held. No AGM held

It will be very helpful if your majesty could reply on the above points and also mention the sections for we lay people, which we could bring it to the registrar's office.

M20 bond is not required to be executed any more by elected members of managing Committee .

elected members would take charge on election results beeing announced by Adminstrator

read the provisions of MCS act for sections

It depends upon the Administrator when he hands over the due charge to the elected members. Provisions are that it should be done after elctions are over and submission of M20 Bond.

Can you please give your opinion on the following - the Society matter.

Our Society was under the Administrator for the last 2 years. After 2 years they had the elections on 27th May 2012 and new members had been elected to form a Committee, Nothing happened till October. When few members approached the Registrar wrt the above matters the administrator just formed the committee in November 2012 stating they had formed the committee in Sept 2012. He has changed the Authorised Signatory and handed over the Society to the new elected members. Which was done without taking an AGM or disclosing the matters to the members of the society. Now we have come to know of the 7 elected members 2 members have resigned.I do not know on what basis.

My querry to you'll is
1)Is the committee still valid.
The M-20 Bond which was to be filled after election was not been filled.
The members of the Society are not aware of what is happening in the society.

administrator must have addressed letter to society that committee has been formed . it is for MC to issue circular to members informing them that they have taken charge .

if 2 members have resigned MC can coopt 2 additonal members .

committee is valid . elections have taken place under supervsion of administrator .

if you are not aware as to what is happening ask for inspection of records . whether MC meetings are being held or not . take inspection .

M 20 bonds have been abloshed . no need for MC to execute bonds .
