s.326 indian penal code

biting by teeth on the finger, that too not severe, will s.326 of ipc will be applied. what would be the correct section on which charge can be framed.

Section 323 IPC. Section 326 is applied if the grievous hurt is caused with dangerous weapons or means and intention to cause hurt is there.

dear kapil,
i adding some thing more,the grievious hurt deals with the section of 320 of ipc,while going through the section 320 it can be seen ,any hurt which endagers life or which causes the suffer to be during the space of 20 days in severe bodily pain ,or unable to follow his ordinary pursuits ,that act of the accused will comes u/s 325 of IPC. but in ur case it is clarified that the injury is not severe and mr.harbajan is resolved the same correctly.
