Goverment Pleder.

Querist : Anonymous (Querist) 22 March 2011 This query is : Resolved
Do Govt. Advocate have rights to move bail petition in court???

some says that ( PP/APP/ cannot move bail application in the courts because they are govt., employees, but Dist., Govt., Pleader/Asst., Dist., Govt., Pleader can move bail application. )

Query : but as we knwon that PP, Addl P.P. are not employee & Asst P.P. is a employee so PP , ADDL. P.P. should have the rights to move a bail application in private partys ? It has been further said that
Pleader can move bail application. But Goverment Pleader means civil advocate & not criminal so how he can approach the bail application ?

So as per the reading of the above brackets words there also one more dought that there is a bar for any civil advocate not to practice in criminal side or vice - versa. when the lawyers register themself to the repsective State bar council the council givs the certificate in it has been stated that a he is only entitled to practice civil cases or criminal cases or tax matter cases or divocre cases like that ?

What do u mean by standing council ?

Pls guied me.

Thanks .

I suggest you to first correct your spelling and then clearly to put your query.

PP or APP both are full time Govt. employees hence they cannot do private practice moreover, their right to privately practice suspends until they are in full time service as Advocates Act 1961.

There is no any distinction/specified certificate being issued by bar Councils authorizing to practice. Any advocate is authorised to do any practice in any field at the same time.

Standing counsel is a private advocate who such been engaged by any department of State etc. for a particular time to defend its case.
