notarized document for carpet area

I had taken possession about an year go Oct 2012 for my new flat and later on in the month of feb13 the builder has notarized and registered an possession letter with respect to the area mentioned as per the agreement which also state that I have no complaints with respect to area and he has taken the original notarized document I don't have any copy of the same but later is found that the carpet area is less and he has charged excess build up from us.What is the remeady can I go in consumer forum.Can I complain in police/EOW as well go in consumer forum AT THE SAME TIME after giving notice.

if carpet area is less than mentioned in agreement you can move consumer forum against the builder for deficency in service and ask for compensation

Can the builder use the notarized and registered an possession letter against me.

First send a notice about the discrepancy in the carpet area. Let the builder reply. You can decide about further action after getting the reply.
