Accident death insurance claim case regarding

My brother in law has died in road accident. Accident caused by a recovery van. The Recovery van registered under Non-Transport Vehicle and the Driver of the Van having LMV-NT category driving licence.
Insurance Company lawyer argued that " the driver is not eligible operate this vehicle hence, insurance company is not liable to pay any compensation to the appellant.
Kindly any give suggestion to move forward in this MCOP case. Also inform if driver drunken , insurance claim is eligible or not..?
