Contradiction regarding solemnization of marriage

Husband states in marriage annulment case before family court that there is no solemnization of marriage.

whereas in the criminal proceeding against his wife the stand taken by him and other witness is that wife did no cooperate for the consummation of marriage and she unwillingly married due to parents compulsion.

When there is no solemnization of marriage the question of consummation cannot arise in criminal proceedings. can this contradiction act in favor of wife in criminal case.
