Carparking in undivided land share

Dear sir,
i have purchased new appartment .
total land value :2782 sqft.
my portion : 660 sqft.
my uds area :348 sqft.
total area of all other portion (including my portion ):5125 sqft .
asper calculation i should have 358 sqft of UDS.But 10 sqft i am losing .(358-348 )
while asking builders i got answer from them "it is my area i have sold out to carparking for three persons "in that one persons belongs to neighbour flats.
is it acceptable as per law ?.please clarify.
