Legality of illegitimate child

Querist : Anonymous (Querist) 07 October 2011 This query is : Resolved
i and my wife have remarried after divorce in our respective lifes as our parents got us married to other people by force and black mail thereafter we married in presence of our friends in a relative's house and have a son 2007 but the twist is my wife divorced immediately after her marriage 2002 and i had to wait for 4 years 2007 during this period my wife had a girl child 2004 with me secretly and thereafter we got married in 2007. now both of us are govt servants and we want to legalise the birth of our child 2004 how to go about this. my office is putting lot of objections and are now questioning the legality of our marraige and asking us to establish our marraige though they have granted paternity leave and maternity leave to us please advise.

Adopt this child as your own. Easy way out.

If paternity and maternity leave was granted then how can such child be termed as illegal. This is your valid child. You both may file an affidavit in support of this fact and you should also get his name registered in the office of Registrar Birth and Death so that a problem may be sorted out for ever.

paternity and maternity leave was granted in respect of 2nd child born in 2007 but they are questioning the legality of our marraige itself in the first place they are saying that since we have not invited anyone so the marraige has not taken place at all. we have election id card where both of us have spouse name

you should get your paternity and maternity leave debited in your other kind of leave if due and settle the matter with your respective dept. you may avail child care leave which is admissable to you after legalisation of your marriage.

how to adopt our own child? there is a provision for grant of maternity leave for unmarried women in govt service can my wife openly say that i had this child as unmarried and later on got married to me and he has accepted my daughter too is this a way out for us to legalise our illegitimate child wil authority invoke bigamy against us even though there is no marraige involved

kuldeep bahi office on its own is doing allthe probe and trying hard to establish that there was relationship between us as we are working in the same central govt dept witha vested interest only to harm our future because one of the officer has conducted enquiry against me way back in 2003 on this matter and failed to establish he has taken it personal and saying that office on its own can proceed against us as it amounts to misconduct. is this correct on his part i need ur advise please
