Sir,
My uncle (elder brother of my father) was allotted a piece of land under the East Pakistan Displaced Persons Scheme in Delhi under a agreement to lease by the Govt. of India. Although my father and other brothers had helped uncle by submitting their affidavits about non-availability of shelter in India etc. at the time of process of application. But my uncle now claims he is the real owner of the property since in Agreement to Lease his name has been mentioned. Please clarify the following points:-
a) Can we file a suit for partition against my uncle mentioning factual status of the allotment of land to him and demand our share of property at this stage,
b) Can we challenge this Agreement to Lease for removing faults.
c) Whether every member of one particular family is eligible for share from this property.

If the plot was allotted in your uncles name and your father facilitated in that allotment then you have no right in that property anymore.

Helping doesn't mean you or your father will become owner.
The plot is allotted in your uncle name.so, you are not entitled to claim that plot.
