Unprobated will

Querist : Anonymous (Querist) 28 June 2011 This query is : Resolved
Sir,
In a property situated in Delhi there are three legal heirs. The property disputes amongst them exists since more than 15 years. Now one of the legal heir filed a probate case in which another legal heir has given no objection through affidavit if the court grant probate to the beneficiary of will. Actually, both the legal heirs in a well planned manner trying to somehow grab legal property share of third heir. Please clarify me appropriate in view of above facts.

Consent of one heir is not sufficient when there is another heir. The third heir can anyway dispute the Will and contest the case for Probate.
