I had given out my flat to a multinational company on registered lease deed for 2 years for a specific employee. The lease expired two weeks back and company as well as myself were both interested in making a new lease deed. Rent was agreed and company even paid stamp duty in registrar office.
However company has now come out with a new format of lease deed which is more favourable to them. I am insisting on same format of lease deed which has expired. So a deadlock has formed. I am wondering how to reolve this issue. Should I do individual lease with the employee himself? What happens to stamp duty already paid by company? Should I keep on persuading the company to change the clauses? Should I give notice to company to vacate the premises? Should I agree to their clauses?

If the terms of the new lease-agreement (proposed) are less favourable to you then you are not bound by them and in that case you can serve a legal notice to vacate the premises and pay the double amount of the in between period.

After the expiry of the earlier lease the subsequent one would be a new lease on such terms and conditions as the parties mutually agree. It is not the question of making the old agreement again. As the this time the lease is being executed afresh its terms and conditions have be mutually agreeable. So your acts depends upon what you want. If you want lease then you can insist on your terms and conditions. If not fle a suit for eviction of the lessee on the round of expiry on efflux of time.
