MUDA site

Querist : Anonymous (Querist) 23 February 2010 This query is : Resolved
Hi,
We brought a site which is approved by MUDA (Mysore Urban Development Authority) but the original owner of the plot (from which MUDA brought) filed a LRRP case against MUDA saying his grand father sold the land without knowledge of them (grandchildren).

The case was in high court, high court gave the verdict in favour of MUDA & quashed the case, now what actions he (petitioner) may take.

What if MUDA loses this case ?,what will happen to our site (Alloted by MUDA) ?.

Thanks

If the property was the self-earned property of grand-father, the grand-children have no case. If it is the ancestral property of grandfather, then the grand-children would succeed if they could prove their right by appropriate documents and evidence.

It is not clear who has gone to High Court of Karnataka against which order. However, presuming that MUDA lost the case in lower court and appealed in High Court, if MUDA loses case, either land has to be returned back to the grand-children or they should be adequately compensated as per the present market rate. In that event, you would have to surrender the site and collect back the amount paid by you.
