Dear sir/madam If petitioner file the Appeal HMA u/s 28 in session court in year 2015, and now he applied widraw application for the same case. So in this case respondant need present at the time of hearing of widraw application hearing on dated 08/07/2017 . My query is respondant need present at the time of hearing ??

It is advisable that the respondent be present in the court to witness and confirm the business that transacted in the court on that date

Respondent need not present when case is to be withdrawn till ther is any counter claim / he want to oppose.

Respondent not ready to give divorce at any cost , therefor petitioner in frustration and make widraw application in the court . Respondent lawyer said she shall be present in court for this hearing. Respondent not raised any for alimony. So she ( respondent) need to present in court for hearing???
