What is plea bargaing?.Is accused of offence u/s 138 of N.I.Act [dishonour of cheque] ask for plea bargaing?.

chapter XXI A of Cr.P.C deals with the concept of Plea Bargaining.

added to Cr.P.C by an amendment act of 2006.

as far as S.138 NI Act, Plea Bargaining is not applicable.

pls read S.265A of Cr.P.C along with Central Government S.O 1042 (E) dated 11-07-2006

but u can proceed under S.147 of NI Act, the offence under S.138 NI is compoundable at any stage may it be appellate stage or revision stage or SLP.

even SC has given judgment on compoundability of 138 NI....m not having the citation right now....but it is reported in 2009 itself.
