Question on selected list

In just completed Recruitment process by State Public Service Commission my merit list is just behind the last selected candidate.But last selected candidate did not option for (he kept blank the column provided in application for tick-mark of that post)the post he get appointed for and the post which he option for are filled up by the candidate in top of merit list.

Now My Question are:-
1.Can State Public Service Commission recommend for the post which candidate not option for.
2- As if last candidate had not been recommended for that post,as per the merit list it would be me the candidate that should be recommend for that post by the State Public Service Commission,as I did option for that post.Do I can file writ against decision of State Public Service Commission???
3.Any leading case in this regard.???

In joint examination the commission can nominate candidate for any service. Even if he has opted for higher service there is no claim fro him if there are candidates with better merit. He will be adjusted (normal /waiting list) on merit.
