Mvc death

when the deceasd was walking on the road, the rider of two wheeler hits the deceasd, due to whch death occured, charge sheet framed against the rider,. it came to know that the RC book owner of the vehicle has died 1 year before, so now whether we hav to claim compensation from rider or from the LR's of the owner? please help me, please
