In Trust suit you have to join Trust by name and all trustees.If the suit is against the third person,jurisdiction is with the Civil Judge,but if the suit is against the Trustee,you have to file the same in the District Court,but before that you have to obtain permission from the Charity Commissioner for filing suit.

Unless it is a matter regarding the functioning of trust all other matters will go normal court.

Thanks MR. Niranjan and Mr. JSKN. It is a matter concerned about an education trust and a suit has to be filed against a trustee by a trustee. I need to confirm regarding the permission to be taken from Charity commissioner. Thanks again. In case of any more details regarding the aforesaid matter from experts is most welcome.
