Hi, My marriage was solemnized as per Christian rites on 15 Oct 2008. I have one daughter aged 1 year 5 months. My wife left my home in June 2010 and took away my daughter with herself. She filed a complaint against me on Aug 2010 with SSP with regard to dowry and harassment. Then a compromise arrived on 28 Aug 2010 that we both file a Mutual consent Divorce Petition. But luckily 2 years separation period is necessary for the Mutual Consent Divorce in Divorce Act 1869. I filed a Petition under Sec 32 of Divorce Act 1869 for restitution of conjugal rights in October 2010.
The case is under trial.
Now please tell me she again give complaint to Women Cell against me & my family. What Can I do now ?

Earlierly you filed a mutual divorce petition. I mean you are one of the petition here in. Then how can you file a petition for restitution of conjugal rights. So am advising you to file a petition or memo for withdrawn your divorce petition. Then your rcr petitio is maintainable. Otherwise its not maintainable.

We did not file mutual divorce petition because 2 years seperation period is necessary in Divorce Act 1869. I filed RCR in Oct 2010 agianst the compromise , I said in petition that the compromise arrived between us is under pressure on me & Still I want to back my wife. Now after the lapse of one year in Conjugal rights case, She go to women cell. What can I do now ?
