That plaintiff filed suit for permanent injunction whereas I had filed counter claim for dispossessing the plot, during the pendency of suit the plaintiff let out the plot to X person and had erected the temporary hut on that plot. I had also issued a legal notice to X but he did not vacate
My query is whether I can add him as a party by way of ‘Addition of Party” or by way “Amendment in Plaint” and also provide whether I have to add / amend him in my counter claim or plaint

File an application under order 1 rule 10 of cpc and implead such person and also file another application seeking amendment in plaint. both the applications shall be accepted at the same time.

As counter claim is your petition , if u filed counter claim petition, better to do all in that which is easier .because, u would have paid court-fee in your case
