domestic violence act 2005

In a case under domestic violence act 2005 a notice has been issued by Legal aid counseling centre to the Railway, who is employer of the victim's husband,to the effect to stop payment of retiral dues,pension of victim's husband who is going to retire in this month till further order. Whether such centre has power and jurisdiction to issue such notice to employer?

This notice is totally unsuatainable and there is no necessity to pay any heed to it. Only the Magistrate can pass such order.

No. specially not in case of retiral dues and pension.

There can be such notice only after passing of any interim order by the Magistrate in the domestic violence case, if not, then can be challenged
