2nd marriage

Hi,

Me and my boyfriend want to marry each other but he is already married (which is not working out a bit) with a child of 2 months. His marriage was not registered under the Hindu marriage act neither any where else. It was a temple marriage between 2 people without the presence of any evidence. For his 2nd marriage, we want to get a registered marriage. Is it legal ?

2nd marriage is illegal Even your marriage is regd., First wife claimed that and proved she is the first wife then your marriage will be void

Not merely the marriage will be void,you will be prosecuted for the offence of bigamy as well.Be careful.

Ask your boyfriend to take divorce from his first wife before he marries you, or get his marriage declared as "void" from a court of law.

Something for you to think. If your boyfriend can think of leaving a two month baby, and make claims that his marriage is not registered etc., to entice/seduce you to get married to him, think what treatment he can give you when he finds a new "girlfriend"? He can claim your marriage is automatically void, because of the existence of the first marriage!

If you marry him with knowledge of his first marriage, the offence of bigamy will be attracted, and section 494 of IPC will be applicable. Your boyfriend can be imprisoned upto 7 years and fined.
