second wife

please let me know my mom is the second marriage to my father, all the property stands on my first mom name. but my mom the own sister of the first wife can i claim the property

Dear Jagadish,

If in case your mom gets property which is of self acquired nature (during the life time of the giver) then it is all right otherwise as per law of succession the marriage being voidable does not have legal sanctity (but the children even if illegitimate are entitled for share in property).

The same is documented either through a legal heirship certificate or Succession Certificate.
