Promotion from peon to clerk

Filling the post of CLERK without advertising for the same in a govt. deptt.,by just promoting a Matriculate peon. Whether it is sustainable in the eyes of law?

Dear Mr.Vijay Kumar,

If in case the Departmental Rules are not flauted and there is transparancy in appointment then in that eventuality there is nothing wrong as such.

there are no common rules for the same except the service rules applicable from state to state and from dept to dept.

if there is any violation of the said rules,the same can be questioned.
