Relief 89

I got some termination compensation and leave encashment in April 2010. Terminated on 30 March 2009.

Can i claim amount as relief under 89 ? Employeer clearly mentioned said amout as termination compensation on final settlement but on form 16 all amount shown as salary.

Please advice.

As written undertaking has already been given by your employer so if violated by him, it gives a legal right in your favour to initiate legal action against him.

Yes since you have got compensation and leave encashment in April 2010,you will have claim relief if any u/s 89 of the Income-Tax act 1961 for the assessment year2011-12.

If the termination compensation is for compensating future salary in that case you shall be eligible for relief u/s. 89(1)
