Leasing out soceity crech

Querist : Anonymous (Querist) 06 July 2025 This query is : Resolved
Dear exports ,
Builder has given creche to soceity but we wanted to know Can we lease out the soceity creche on rent to generate some income for betterment of soceity as per maharashtra Co-operative soceity act 1960.
T. Kalaiselvan, Advocate (Expert) 06 July 2025
In Maharashtra, a creche built by a builder in a housing society is primarily intended to provide childcare facilities for residents, particularly working parents.
While the builder may have an initial agreement with the society regarding the creche's purpose, the society, upon formation and conveyance of the land, can decide on its usage, including potentially renting it out, subject to by-laws and approvals.
Any decision to rent out the creche would need to be in accordance with the society's by-laws and may require approvals from the relevant authorities, such as the Registrar of Cooperative Societies.
Renting out the creche could generate income for the society, but it's essential to consider the operational costs and potential impact on residents.
Any decision regarding the creche should be transparent and communicated to all members of the society.
The society should consider the needs and preferences of its residents when making decisions about the creche.
The society must ensure that all actions related to the creche comply with relevant laws and regulations.

It is within perview of the General Body decision, however, there is no legal infirmity.
You may agree renting out creche to outsiders (non-residents) may create some security problem.
