It is often seen that notaries charge 100, 200, 500 rupees for notarizing affidavits or agreements, whereas according to notary rules, the prescribed fee for notarizing affidavits and agreements is only 35 rupees. In such a case, can notaries charge more than the fee prescribed by the said rules? Is this legal? Is the fee list of notary rules not mandatory?

If you type the matter that you want on stamp paper as required, it will be a document. Then, the notary will attest the document with a notary stamp, and he will charge a minimum fee. But all parties will go with free hands, and they only say that they need notary attestation. So they will charge some amount than normal. However, you may choose another notary who attests with a low fees.

A notary public in India cannot charge extra amounts beyond the fees prescribed by the government.
The Notaries Act, 1952 and Notaries Rules, 1956 specify that notaries can only charge fees within the rates set by the appropriate government and these rates must be displayed in a conspicuous place.
The appropriate government (Central or State) has the authority to fix the fees for various notarial acts.
In addition to the basic fees, a notary can charge a travel allowance of ₹20 per kilometer.
Charging excessive fees beyond the prescribed rates is a violation of the rules and regulations governing notaries.
This can lead to disciplinary action against the notary.
