GO thru enactments that apply to establishment Factory Act/ and Rules as in state and if IT is covered by ESI. If not the injury due to say; dangerous/hazardous operation may be fastened on employer. Refer the matter to legal cell of establishment or to a very able senior LOCAL counsel of unshakable repute and integrity specializing in Labor matters and well versed with latest citations, LOCAL applicable rules/laws/ … and having successful track record…. and worth his/her salt….. Check for such counsels at LOCAL Labor court/CGIT…..
