Water leakage from floor above

I have water leakage from the floor above. Do I have to pay for fixing it or it is the responsibility of the person living in the flat above.

owner of upper flat will not repair unless made to repair.

Try to have amicable settlement.

Either Society or the owner of above flat is liable to repair.
