Extension for joining

Hello sir,
I am Shyju , working as staff nurse at Jai prakash narayan apex trauma center(JPNATC)_AIIMS, new Delhi. Now I got selection in National institute of mental health and neuroscience (NIMHANS) BANGALORE, as a staff nurse.Both are Central govt. Autonomous institutions, so applied for a technical resignation for 3 month period, so I have requested for 3 months extension for joining at NIMHANS.But they granted only one month(on or before29/7/2015),if I cannot join before the above date my selection automatically canceled and they will call for next wait listed candidate. I asked about this problem in my current institution, JPNATC, they said if I am resigning before three month , I have to pay balance period salary which is about more than a lakh. So I would request what should I do to get the extension. I saw in DOPT rules, may allow an employ to get an extension maximum up to 9 months, but I don't know which is applicable in my case. Please give me a solution.

May be, NIMHANS has the urgency fill up the post. You may request your present employer to relieve you early. As it is case of technical resignation, their insistence is unfair.

Dear Shyju,

Some times the opportunity is at some cost. opportunities lost some times cost very much than the cost you are likely to pay to enjoy the opportunity. Opportunity lost cannot be regained easily. If you see development of your career or service at or near home town, you should not be shy of paying the sotice period pay at your present employment (JPNATC) to join NIMHANS.

There are no hard & fast rules about extension of joining time. Instruction of the Government of India are general guidelines for the Government employers. Extensions are always discretionary subject to the exigency and interest of service.

Sir,
In my no objection certificate (NOC) its clearly mentioned, 3 months notice period is needed to relieve from my duty, which i shown at my certificate verification time also. Can i request once more for extension, or can i move legally? Or should i pay the full salary of two month? Please do help me

Extension of time is the sole discretion of the NIMHANS. If you move legally, you would not only be loser of the case, but also time to join would get expired.

So, better pay the amount of salary for the period short of notice period, if you really want to join the new post without any burden on your mind.
