Child surname

Is it necessary to use fathers surname for child. Could mothers maternal surname be used with child's name ( If mother is using her previous surname after marriage)?

Yes Sir,

Me and my husband are on our way to have divorce. For nearly three year we are staying separate. My husband has never shown any interest for me and for our child. Now its time to admit our child in school and so I want to know that if I can use my maternal surname with our child's name as I am using my maternal surname after marriage.

Also is there any legal bindings for using/not using my maternal surname?

Please let me know....
