dropping of case u/s 258 of CrPC

Dear friends,
In criminal case filed on police report u/s 184 &185 of Motor Vehicle Act.The police filed charge-sheet.The stage of case is for recording of plea of accused.I move application for dropping of case as sec.184 &185 of M.V.Act. is non-cognizable in nature as punishment prescribed in the Act.H'ble Court call say of APP .APP move application for alteration of charge u/s 279 of IPC.Now the question comes that case is of summary nature even sec.279of IPC is a summary trial .Then how can charge be alter when there is no framing of charge in summary case.
Please advise to file reply to the application of APP for alteration of charge
