Illegally father's property taken by uncle's son

Hello Sir,

I live in West Bengal. We have a property in Varanasi. But my uncle's son has illegally registered my father's property by placing someone else in place of my father. Even my uncle become witness in that. We have a xerox copy of land deed.

Now they are threatening us not to come to varansi to file a case.

Sir, is there any way to file a case against them from West Bengal or anyway to punish them from here?

You have to file the case only in the jurisdiction of the Court in which the immovable property is situated.

Hello Sir,

Thank you for your valuable feedback. Just wanted to know one more thing. As this is very dangerous for us to go that place hence is there any other way to get them without moving their, like at least sending them notice for their illegal work.

The suit can be filed by your father i.e. suit for partition in ancestral property. Without your physical appearance, this is not possible to file a case. If they harm you and your father ,or threatening , you can lodge police complaint and can also ask for Police Protection.
