Sorry for trouble again, if the smilar cause of action was decided in plantiff favour in another case (multiple cases on same issue due timing issue) which was parrelly running with this case, in that case can court decide to dismiss this case.

yes on grounds of res judicata .same issue involved in previous suit then subseqent suit would not be maintanable .
