Dear Sir,
We are having ancesstral hotel in Meerutwhich was made by my Grandfather. Gradfather further transferred this Hotel in the name of his two sons my father & my uncle.My Uncle & his son have captured the entire Hotel & they are giving us no income. My father has expired & they are not giving us our share . what is the course of action so that I and my brother can claim our share. This hotel is of Nagar Nigam &is leased property. Moreover on our share of Hotel they have made shops for renting the same
If i take stay on the property can they rent these shops . I want to prevent them for selling our property & take our share back which has been captured by them.
Please advise what should i do in legal way

contact a local lawyer . you will have to file a suit for claiming your share in property and for injunction restraining your uncle from selling the property or creating third party rights

Dear Querist,
This should be, in my considered opinion, your course of action :-
1. Seek a permanent injunction (stay) on renting your part of the hotel.
2. Partition of leasehold rights.
3. Appointment for reciever for receipt of rents until dispute is settled.
